2025 Doe Run Land Exchange (LEX) Proposal #68873

This project covers a Land Exchange (LEX) of approximately 353.7 acres of private lands, adjacent to Mark Twain National Forest (MTNF) land on the Houston/Rolla/Cedar Creek (HRCC) Ranger District for approximately 2,616.11 acres of Federal lands.
NOTICE OF EXCHANGE PROPOSAL and OPPORTUNITY TO COMMENT
LAND-FOR-LAND EXCHANGE.
 
Notice is hereby given that the Forest Service (FS), United States Department of Agriculture, is considering an exchange of land (interests in lands) with Doe Run Resources Corporation under the authority of the Act of March 1, 1911(Weeks Act), as amended, Federal Land Policy and Management Act of October 21, 1976, as amended, and Federal Land Exchange Facilitation Act of August 20, 1988 . The lands (interests in lands) under the jurisdiction of the Forest Service within the boundaries of the Mark Twain National Forest that are being considered for exchange are located within the following townships in Reynolds, Iron, and Shannon Counties, State of Missouri:

Reynolds County: Township 32 North, Range 1 West, Township 33 North, Range 2 West, Township 33 North, Range 1 West, Township 32 north, Range 2 West Shannon County: Township 31 North, Range 2 West Iron County: Township 34 North, Range 2 West, Township 35 North, Range 2 West
 
The non-Federal lands (interests in lands) being offered for exchange by The Doe Run Resources
Corporation are located within the following townships in Texas County, State of Missouri:
 
NON-FEDERAL PARCELS
 
Texas County: Township 33 North, Range 10 West
 
Any or all the above-described lands (or interests in lands) may be exchanged if the values are equal. If the values are unequal, either party may equalize the values by making a cash payment, not to exceed 25 percent of the value of the lands (interests in lands) transferred out of Federal ownership.
 
The Forest Service proposes acquiring land with floodplains associated with the Big Piney River in Texas County. There are no floodplains reported on Federal lands that the Forest Service proposes to exchange.
 
The Forest Service is interested in acquiring the non-Federal parcels. The exchange proposal is currently being analyzed to determine whether it is in the public’s best interest to acquire the parcel. Persons claiming such properties or having valid objections to this proposed exchange must file their claims or objections with the Forest Supervisor, Forest Service, United States Department of Agriculture, Mark Twain National Forest, 401 Fairgrounds Road, Rolla, Missouri
65401, within 45 days after the initial date of publication of this notice.
 
An environmental assessment (EA) for impacts surrounding this proposed land exchange is being developed. The Mark Twain National Forest’s Supervisor invites you to comment on the proposal’s preliminary impact of proposed actions within the activity area. If approved, this land exchange may result in up to 2,616.11 acres of National Forest System lands for up to 353.7 acres of private lands. This notice constitutes the notice of opportunity to comment on the Doe Run Land Exchange (LEX) proposal per Forest Service administrative review procedures at 36 CFR § 218.22. No other designated comment period for this proposal is planned. Specific, written comments must be postmarked by the Postal Service, or otherwise submitted (for example, express delivery service) by 11:59 p.m. in the time zone of the receiving office on the 45th calendar day following the initial date of publication of the legal notice in the Phelps County Focus (the newspaper of record). It is the responsibility of all individuals and organizations to ensure that their comments are received in a timely manner. Specific written comments should be within the scope of the proposed action, have a direct relationship to the proposed action, and must include supporting reasons for the responsible official to consider (36 CFR § 218.2). All public comments and objections, including names and addresses of those who comment, will become part of the public record for this proposal and will be subject to review pursuant to the Freedom of Information Act.
 
The proposed activities are subject to a pre-decisional objection process described in 36 CFR § 218, Subparts A and B. Objections will only be accepted from those who have submitted specific written comments regarding the proposal during a designated opportunity for public comment (36 CFR § 218.5). Issues raised in objections must be based on previously submitted timely, specific written comments regarding the proposal unless based on new information arising after designated comment opportunities (36 CFR §218.8(c)).
 
Individuals and organizations wishing to be eligible to file an objection must provide the following with their comments: (i) Name and address; (ii) Title of the proposed action; (iii) Specific written comments on the proposed action, along with supporting reason the Responsible Official should consider in reaching a decision; and (iv) Signature on comments
submitted or other verification of identity upon request.

Electronic form submission through the proposal’s webpage is preferred but written hardcopy comments concerning this proposal may be submitted to: Mark Twain National Forest, Attn: Forest Supervisor, 401 Fairgrounds Rd. Rolla, MO 65401. The office business hours for those submitting hand delivered written comments are Monday - Friday 8:00 a.m. – 4:30 p.m. Central Time, excluding Federal holidays.
