The Forest Service draft decision notice (DDN) and Finding of No Significant Impact (FONSI) is subject to the Forest Service pre-decision objection process pursuant to the provisions found at 36 CFR Part 218 Subparts A and B. Objections to the FS draft decision to authorize use and occupancy for the BXP must be filed within 45 calendar days from the publication date of this legal notice in The Milwaukee Journal Sentinel which is the newspaper of record for decisions made by the Eastern Region Regional Forester. The publication date of this legal notice in the newspaper of record is the exclusive means for calculating the time to file an objection. Those wishing to object should not rely upon dates or timeframe information provided by any other source. If the 45th day falls on a weekend or Federal holiday the next business day marks the close of the objection period.
Issues raised in objections must be based on previously submitted timely and specific written comments regarding the proposed project or activity during the FERC’s initial scoping period (October 16-November 16 2017) or the Forest Service’s 30-day comment period (May 20–June 18 2019) unless based on new information arising after designated comment opportunities (§218.8(c)).
Incorporation of documents by reference is permitted only as provided in §218.8(b). It is the objector's responsibility to ensure timely filing of a written objection with the reviewing officer.
At a minimum an objection must include the following: the name address and if possible a telephone number of the objector; a signature or other verification of authorship (a scanned signature for electronic mail may be filed with the objection); identification of the lead objector when multiple names are listed on an objection; reference to the Buckeye Xpress Project or BXP the Ironton District of the Wayne National Forest and the Responsible Official Acting Regional Forester Robert Lueckel; a statement of the issues and/or the aspects of the project to which the objection applies; if applicable a statement explaining how the environmental analysis or draft decision specifically violates law regulation or policy; suggested remedies and supporting reasons; and a statement that demonstrates the connection between prior specific written comments and the content of the objection unless the objection concerns an issue that arose after the designated opportunities for comment ( §218.8(c).
