LEGAL NOTICE OF OPPORTUNITY TO OBJECT TAHOE NATIONAL FOREST E-BIKE TRAIL DESIGNATION PROJECT TAHOE NATIONAL FOREST Nevada, Placer, Sierra and Yuba Counties The Tahoe National Forest is announcing the release of the Final Environmental Assessment (Final EA) and Draft Decision Notice (DN) and Finding for No Significant Impact (FONSI) for the Tahoe National Forest E-Bike Trail Designation Project, available for public review and objection on the Project website: https://www.fs.usda.gov/r05/tahoe/projects/302695. The Proposed Action includes designating Forest Service system non-motorized trails as open to Class 1 E-Bikes within the Tahoe National Forest on the American River, Truckee, Sierraville, and Yuba River Ranger Districts. Of the proposed 143 miles of Forest system trails, 119 miles are existing routes currently available to visitors for hiking, mountain biking, and equestrian uses, while 24 miles are routes that were approved for non-motorized use under previous decisions made before the Forest Service revised its travel management policy (FSM 7705) but that have not yet been constructed. Reconstruction and rerouting of existing routes is not included within the scope of this Final EA. The Final EA and Draft DN/FONSI are subject to the pre-decisional administrative review (objection) process pursuant to 36 CFR 218, Subparts A and B. The Forest Supervisor of the Tahoe National Forest is the responsible official for the Project. Written objections, including any attachments, must be filed with the reviewing officer (Regional Forester) within 45 days following the publication date of this legal notice in Grass Valley’s The Union newspaper. If the objection filing period ends on a Saturday, Sunday, or Federal holiday, the time period for filing objections is extended to the end of the next Federal working day. The publication date of this legal notice is the exclusive means for calculating the time frame in which to file an objection. It is the objector’s responsibility to ensure evidence of timely filing of a written objection with the reviewing officer (36 CFR 218.9). In accordance with 36 CFR 218.5(a), objections will only be accepted from those who have previously submitted specific written comments regarding the Project during the designated opportunity for public comment (i.e., the 30-day scoping comment period). Eligible individuals and entities who wish to submit objections must do so in writing to the Regional Forester. Attachments in electronic submissions must be in common formats (.doc, .pdf, .rtf, .txt). Issues raised in objections must be based on previously submitted timely, specific written comments regarding the proposed Project, unless based on new information arising after designated opportunities for public comment. Objections must include: 1) name and address, with telephone number, if available; 2) signature or other verification of authorship; 3) identity of a single lead objector when applicable; 4) project name, Responsible Official name and title (Amber Waters, Acting Forest Supervisor, Tahoe National Forest), and name of affected National Forest(s) and/or Ranger District(s); 5) reasons for, and suggested remedies to resolve, objection issues; and 6) description of the connection between objection issues and objector’s prior specific written comments on the proposed Project (36 CFR 218.8(d)). Incorporate documents by reference only as provided for at 36 CFR 218.8(b).Information received with objections, including names, addresses, email addresses, and phone numbers of those who object, will be considered part of the public record and will be available for public inspection.
